Section 3 — Orders

When you place an order, you are making an offer to purchase. Mineforth may accept or decline an order as permitted by applicable law. An order is not accepted until we send an order confirmation or otherwise confirm acceptance. We must receive and process payment before an order is accepted.

Please review your order carefully before submitting it. We may be unable to accommodate a cancellation request after an order has entered processing or fulfillment. Cancellation requests are handled in accordance with our Order Cancellation Policy.

If we decline, change, or cancel an order, we will attempt to notify you using the email address, billing address, or phone number provided with the order. If payment has already been collected for an order or item we cancel, we will issue an appropriate refund to the original payment method.

Returns, exchanges, and refunds are governed by our Return and Refund Policy.

You represent that purchases are for personal or household use and not for unauthorized commercial resale or export.

Section 4 — Prices and Billing

Prices, discounts, and promotions may change without notice. The price charged will be the price displayed when the order is placed, subject to the correction of clear errors as permitted by applicable law, and will appear in your order confirmation.

Product prices are displayed and charged in U.S. Dollars (USD). Free standard shipping is available for orders delivered within the United States, as described in our Shipping Policy. Applicable sales tax and any other mandatory charges will be clearly disclosed before you complete your purchase.

Promotions may be subject to separate terms. If promotional terms conflict with these Terms, the promotional terms will govern for that promotion.

You agree to provide accurate and complete purchase, payment, and account information and to update that information as necessary so we can process transactions and contact you about your order.

  • Charges incurred by you will be honored by the payment provider.

Section 5 — Shipping and Delivery

Shipping destinations, costs, handling times, estimated transit times, and related conditions are described in our Shipping Policy. Delivery dates are estimates unless expressly stated otherwise.

We are not responsible for carrier delays or events outside our reasonable control. However, if we cannot ship within the timeframe stated at the time of purchase—or within 30 days when no shipping timeframe was provided—we will notify you of the delay and provide a revised shipping date where available.

You will be given the opportunity to consent to the delay or cancel the unshipped order for a full and prompt refund, as required by applicable law. If required consent cannot be obtained, we will cancel the affected order and issue a prompt refund.

The Services—including trademarks, brand elements, text, displays, images, graphics, product reviews, video, audio, and their design, selection, and arrangement—are owned by Mineforth, its affiliates, or its licensors and are protected by applicable intellectual property laws.

Mineforth’s names, logos, product and service names, designs, and slogans are trademarks of Mineforth or its affiliates or licensors and may not be used without prior written permission.

Shopify’s names, logos, product and service names, designs, and slogans are trademarks of Shopify. Other names, logos, and brand elements appearing through the Services belong to their respective owners.

Section 7 — Optional Tools

We may provide access to tools made available by third parties that we do not monitor or control.

Access to such tools is provided “as is” and “as available,” without warranties, representations, conditions, or endorsements of any kind, to the fullest extent permitted by law. We are not liable for claims arising from your use of optional third-party tools, except where liability cannot lawfully be excluded.

Mineforth is powered by Shopify, which provides technology that enables the Services. All purchases from our store are made directly from Mineforth.

Shopify is not the seller of Mineforth products and is not responsible for order fulfillment, customer service, returns, refunds, product claims, or other aspects of transactions between you and Mineforth.

Nothing in this section limits rights or remedies that cannot be waived under applicable law.

Section 10 — Privacy

Personal information collected through the Services is handled in accordance with our Privacy Policy. Certain information may also be processed by Shopify in accordance with Shopify’s Privacy Policy.

Because the Services are hosted by Shopify, Shopify processes certain information relating to your access to and use of the Services.

  • You own or have the necessary rights to submit the Feedback.
  • You have disclosed any compensation or incentive connected with the Feedback.

We are not required to keep Feedback confidential, pay compensation for it, or respond to it unless required by law or separately agreed in writing.

We may monitor, edit, or remove Feedback that we reasonably determine is unlawful, offensive, threatening, defamatory, obscene, misleading, infringing, or otherwise violates these Terms.

Feedback must not violate any third party’s intellectual property, privacy, publicity, or other rights; contain unlawful, abusive, or obscene material; contain malicious software; or misrepresent its source. You are responsible for the Feedback you submit and its accuracy.

Subject to applicable law, we may correct errors, update information, or cancel an affected order. If we cancel an order after collecting payment, we will issue an appropriate refund to the original payment method.

Nothing in this section limits obligations concerning accurate advertising, pricing, fulfillment, or refunds under applicable law.

You remain responsible for amounts properly incurred before termination.

To the extent permitted by applicable law, you agree to indemnify and hold harmless Mineforth, Shopify, and their respective affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from third-party claims, losses, damages, liabilities, and reasonable legal fees arising from:

  • Your unlawful or unauthorized use of the Services.

We will provide reasonable notice of an indemnifiable claim. Failure to provide prompt notice will relieve you of your obligations only to the extent you are materially prejudiced.

We may control the defense and settlement of the claim, but we will not agree to a settlement that imposes a non-monetary obligation on you without your reasonable consent. You agree to provide reasonable cooperation in the defense.

If any provision of these Terms is held to be unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the unenforceable portion will be treated as severed.

The remaining provisions will remain in effect.
